Applies to: WySMart.ai, WySMartDigital.com, and all digital services/products provided by WySMart Digital LLC.

1. Acceptance of Terms

By accessing or using our websites, AI tools, SaaS apps, CRM systems, SMS/email automation

tools, or consulting services, you agree to be bound by these terms.

2. Services Provided

WySMart provides:

- AI-driven funnel building, CRM & automation platforms

- Social media scheduling and email/SMS marketing tools

- Website design, hosting, analytics, SEO and reputation tools

- Custom-built AI assistants and integrations with your stack

3. Client Responsibilities

Clients must:

- Provide legal opt-in leads for campaigns

- Use tools ethically and follow platform policies (e.g., Facebook, Google, Twilio)

- Maintain backups and security on self-hosted tools

4. Subscription Plans & Payments

Subscriptions are billed in advance on a recurring basis unless canceled.

Some services carry setup or onboarding fees.

5. AI and Automation Disclaimer

AI services are predictive and based on historical inputs. Performance may vary. We offer no

guarantees for specific business outcomes.

6. Ownership & Licensing

You retain full ownership of your brand. WySMart retains ownership of proprietary tools, templates,

training, and AI engines unless agreed otherwise.

7. Support & Uptime

Support is provided via email and chat during normal business hours. While we strive for 99.9%

uptime, services may be interrupted by external providers.

8. Termination & Suspension

We reserve the right to suspend services for non-payment, abusive behavior, or platform misuse.

9. Limitation of Liability

Our liability will not exceed the fees paid to us in the 3 months preceding a claim. We are not liable

for platform bans, external outages, or third-party disruptions.

10. Updates to Terms

We may revise these terms periodically. Continued use of services implies acceptance of changes.
